Stop the presses!

A lawsuit’s been filed in Cook County, Chicago against Ted Cruz‘s eligibility for the high office of President of The United States. And guess what, It will be heard. Wow.

This may dominate the political news for the next several weeks.

The surprise is that is was filed by a lawyer named Lawerence Joyce who just happens to be a Ben Carson supporter. Even though it had been Donald Trump who had come after Cruz on this issue.

The basis for the lawsuit is real.

Cruz was born in Canada, and while his mother was a U.S. Citizen his father was not. The rules state you must be born in the United States or if you migrate to the U.S. both parents needed to be U.S. Citizens. Clearly that’s not eh case with Cruz.

Oh, boy.There are some possible loop-holes which might protect Cruz. However, the constitutional rules are unclear. So while Cruz can argue his point, he also could lose.

Then what?

Is Donald Trump behind all this?

We don’t really know.

In fact, in all likelihood Carson will be under pressure along with Jeb Bush to drop out of the race as soon as both are crushed in South Carolina by Trump, Cruz and Marco Rubio.

Carson and Bush are likely to get less than 10% of the vote again.

Carson and Bush have said they may stay in, but that could easilychange change. Because if they stay in, establishment Republicans are concerned there will never be a clear No. 2 behind Trump.

Meaning the Donald might pretty much lock up the nomination really soon. He does look pretty unbeatable at this time.

Trump and Carson have always seemed like debate buddies, so is it possible Trump master minded this plan with gentle Ben his choice for vice president?

It makes some sense.

Carson could bring in the minority votes needed to win against the democrat.

As of today, Trump is now leading not only the Republican party, but in most polls against both Hillary Clinton and Bernie Sanders.

And the Pope’s attack on Trump not being a good Christian may only help Trumpeter.

Besides, all the republicans – not just Trump – and to build the wall.

So singling Trump out was not a blow but a strange kind of recognition of Trump’s power and standing.

Trump continues to be THE NEWS daily and is far ahead of all the other candidates.

It’s his race to lose now.

    Watched the Town Hall formats the last two nights with the GOP candidates and while you don’t get the friction and fireworks, you also don’t get the 30 second sound bite answers. The chance for a candidate to face a voter directly is powerful and one can form a very different opinion. While I’m a democrat, Carson is an extremely likable and capable guy. We could do a lot worse. I thought Rubio had a positive night the first night also. Cruz, ehhh. Last night I thought Kasich was good and Bush didn’t shoot himself but not getting Nikki Haley’s endorsement really hurt him I think with the SC voters. He has his back to the wall now, but I still don’t see him dropping out yet.

    With Trump, I think he does better in a debate format than a Town Hall format. I thought he blew almost every question he was asked. The question on whether he should have called Bush a liar didn’t go well for him and when the insurance agent asked him about his plan to replace Obamacare, he rambled on about the proposed budget for awhile. At least twice before, Trump has talked about a single payer plan and how much less countries that have it now, spend on health care but last night he completely ran away from his previous support for a single payer plan (smart) and gave the standard GOP response on eliminating state line barriers. The questioner didn’t look like he was happy with the response. I don’t think the question on his temperament went especially well for him either. Trump did fine for the most part dealing with the Pope issue. Probably a minor thing but the other five candidates over both nights all stood up and walked over to face the questioner when the audience got involved. Trump stayed seated. I still don’t think Trump is a true Republican but that’s not my call. Really anxious to see how South Carolina plays out.

    One topic I’d love to see addressed here is Kansas City political consultant Jeff Roe who is heading up Cruz’s strategy. Roe has a “dirty tricks” reputation and it is showing with a lot of the questionable moves Cruz has made ( the message in Iowa about Carson dropping out, the online message about Trey Gowdy withdrawing his endorsement of Rubio, the photoshopped picture of Rubio shaking hands with Obama, etc.).

      Iimagine trump not knowing anything about health care…saying
      as usual “lets destroy ACA” then going stupid without a plan to
      replace it leaving everyone without insurance. Or he says bomb the
      hell out of Libya/Syria then Hillary explaining her personal intake and
      involvement in the situation and how bush cause all this and how congress
      didn’t work with the rest of the government to hlp avoid this situation.
      Trump knows nothing about politics/current events/and yes he can attract
      the low information/racist American crowd including the white
      supremecists like chucklet but one on one he’s TOAST.
      He can yell all the inflamattory comments he wants….but Hillary only
      needs to remind the 40 million Hispanics of trumps hatred of them to
      win the election.
      And even if pretty boy rubbit is up there with her…hes so lazy she’ll wipe
      the floor with his spray on hair.
      Yes stomp…when these guys have to speak for an hour to an hour and
      a half (especially rubbit who has 4lines and how many times can he repeat
      them?) they’ll look like idiots in both domestic and foreign affairs.
      SORRY SOUTHY/WHINEY……its gonna be fun.
      The rethugs need to do a little homework…but it won’t save them.

      The video is interesting.

      At about 4:50 he makes the point that “Fear” drives the electorate and shows wolves approaching the camera while claiming Kerry cut the defense budget by 6 billion, then, shows the Twin Towers coming down. His implication in my opinion, is that the “Fear” that people have is unfounded in fact, then, again, he shows the Twin Towers coming down.

      If fear, derived from facts, drives the electorate, then why is he apologizing for it? Did the Twin Towers come down and are Muslims the catalyst for 99% of the terrorist attacks in the world?

      Is this 3rd world, stone age cult, responsible for terror or not? Does that culture, have a history of terror and violence over the last 1400 years that we Americans should be fearful of or not?

    So, if it were to come down to Canadian Cruz and indicted Hillary, will the parties do a do over? What court is hearing the Cruz case? Is there standing? The solution for all is just appoint Cruz to the Supreme Court. He knows the Constitution, has argued cases before the high body, and would follow in Scalia’s footsteps. Problem: Obama won’t nominate and Senate won’t Confirm.

      Yes, there is standing. The Civil Procedure problem here is ripeness. Is it ripe if Cruz wins the nom and is placed on the ballot under the Repbublican (this is my opinion) or is it after he is possibly elected president.

      The most likely outcome is that the Supreme Court will punt on making a decision altogether because of what they call “Political Question Doctrine” which is:

      A “textually demonstrable constitutional commitment of the issue to a coordinate political department; or”
      A “lack of judicially discoverable and manageable standards for resolving it; or”
      The “impossibility for a court’s independent resolution without expressing a lack of respect for a coordinate branch of the government; or”
      The “impossibility of deciding the issue without an initial policy decision, which is beyond the discretion of the court; or”
      An “unusual need for unquestioning adherence to a political decision already made; or”
      The “potentiality of embarrassment from multifarious pronouncements by various departments on one question.”
      (Baker v. Carr, 1962)

      If the case is prosecuted after Cruz wins, Cruz will likely stay president despite his Canadian problem because of #5.

    Interesting issue.

    Since Teddy was born in Calgary, Canada, to a Cuban father and an American mother, it is legally unclear (that is, there has a yet been no ruling on this issue) whether the psychopath is qualified to run for the office. The normal rules are as follows:

    1. Born on U.S. soil, regardless of their parents’ citizenship;
    2. Born outside the U.S. to at least one American parent;
    3. Born outside the US, then naturalized & subsequently granted U.S. citizenship.

    Cruz clearly quals #2…except for this:

    Article II, Section 1 of the Constitution: No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

    The issue at hand is the term “natural born Citizen.”

    Regardless of the legal outcome (for or against Cruz, in particular) it is nice to see this ambiguous language finally addressed by the courts: one only has to remember the weird national urge to have Arnie run to understand why…

    As I have said the race depends on the Hispanic vote and Hillary did great there.
    I pray trump get nomination because Hillary will rip off his head and beat him
    by landslide numbers. I am waiting for demo numbers to come in so I can
    see how strong Hillary will be in the general. Rethug candidate MUST get in the
    40’s-45% of Hispanic vote or its not even close…trump/rubio will get 8% and the
    little young dude who now wants total deportation (like trump) will get maybe
    20%.
    Harley was perfect in 2012….he looks to be perfect in 2016 also. The rest of
    the kcc crowd is far behind on all the subjects from sports to politics…but
    glaze might know the hotties but the clock is ticking on him there.

    So I will be waiting anxiously for south Carolina primary dem votes and Nevada
    repub votes.
    Sanders really had to win Nevada. Its a caucus state and that’s the type of states
    where a”revolutionary/out of the establishment” candidate must do well.

    Welp…Trump is nearing the end of the trail for locking up the nomination. We were one of the first to say he could and would get that done. It’s a bit surprising yes. With Bush gone and soon Carson that gets it down somewhat to a three man race. As long as its three TRUMP WINS…the others two split the vote and he wins nearly every primary. Just the way it is.

    As for Demo’s well its far from decided yet. Hilary is in a gun battle with Bernie…I think Clinton will win but the old guy still has a ‘shot.’

    As time moves forward we will be looking at the likely debates and stories of a Trump-Clinton run. I’ll say it now…Trump will beat her.

    The more you look at this race, the more you see Donald Trump as the next president. His momentum is just massive and media loves him. He is a star, nobody else really is that are they. He is ANTI ESTABLISHMENT and the ‘people’ love that. Though a billionaire, a middle of the road guy, doesn’t have a clear plan guy…doesn’t matter. The nation is fed up with politics as usual…he is the new rock star….I think he wins. When its just him and Hilary or Bernie…he just has more attention, more charm, more ‘regular guy’ talk then the ohters….Hilary is smarter, she is much more up on things than Donald, but he will attack her and charm the tv viewers on the debates against her. I don’t think she can beat him. Sanders would give Trump a tougher road, he has less to attack. He seems a ‘good and caring guy’ … Clinton comes off as ‘boy I just want to be president..think of the parties and people who will look up to me that much more’ Trump may in real life be the same..but we all think he’s tougher, and won’t take the b.s. and maybe just maybe will appoint ‘managers’ to high office with experience to get it done and truly make things better….I think its Trump’s job to lose now. I believe he will win it all. p.s. I usually am a democrat…hmm.

    So children born to a parent in the Military or on vacation in a foreign country are not natural born citizens? If an Army Capt marries a woman in Spain and they have a child, you think this child is not natural born? The actual “rule” as you call it is this…Must be born to at least one natural born citizen of the U.S. who resided at least 3 years on US soil. Cruz mother was born here. Period. This is just another shell game for the rubes by PT Trump, much like his birther feud over Obama. Cruz wont be President for a multitude of reasons, but not because of birther claims. Its going to come down to Hillary vs Trump and there isnt much difference between them. We are screwed either way. In fact, a CNN anchor described Bernie’s beliefs and asked Trump who she had described, he replied “Me, Donald Trump”.
